STUDIO TERMS & CONDITIONS

Welcome to Athletica Pilates. Please read our Terms & Conditions carefully. It is a condition of attending classes and entering our studio that you agree to these Terms & Conditions.

Remember:

  • Treat all people and property at the Studio with care and respect.

  • Participating in Pilates involves physical exercise and carries an inherent risk of injury. You participate at your own risk.

  • Tell us and your instructor before class if you have any injury, illness, discomfort or are pregnant.

  • We recommend leaving valuables at home. We are not responsible for loss or damage to personal belongings.

  • Memberships and class packs are subject to the specific terms for that option, including expiry dates and cancellation windows — see the Schedule at the end of these Terms.

PART A – GENERAL STUDIO TERMS

1. Welcome

Welcome to Athletica Pilates ("Athletica", "we", "our", or "us"). Athletica Pilates is owned and operated by APCORE PTY LTD (ABN 50 619 150 604).

These Studio Terms & Conditions govern your use of our studios, website, booking platform, memberships, class packs, retreats, workshops, events and all other services provided by Athletica Pilates.

Our aim is to provide a welcoming, safe and supportive environment for every client. By booking, purchasing or attending any Athletica service, you agree to comply with these Terms & Conditions.

If you do not agree with these Terms, you should not use our services.

2. Definitions

For the purposes of these Terms:

  • Booking means any reservation made for a class, workshop, event or retreat.

  • Business Day means Monday to Friday excluding NSW public holidays.

  • Class means any Pilates, strength, mobility, recovery or other fitness session offered by Athletica.

  • Class Pack means a prepaid package of classes with an expiry date.

  • Client, Member, you or your means any person who attends, books or purchases services from Athletica.

  • Membership means an ongoing recurring membership paid by direct debit or other approved payment method.

  • Retreat means any retreat, travel experience or wellness event organised by Athletica.

  • Studio means any Athletica Pilates location now operating or opened in the future.

  • Website means the Athletica Pilates website and associated online booking systems.

3. Acceptance of These Terms

By:

  • creating an account;

  • purchasing a membership;

  • purchasing a class pack;

  • booking a class;

  • attending a class;

  • attending a workshop, event or retreat; or

  • using our website,

you acknowledge that you have read, understood and agreed to these Terms & Conditions.

If you are purchasing a membership on behalf of another person, you confirm you have authority to do so.

4. Changes to These Terms

We may update these Terms from time to time. The most current version will always be published on our website.

Where changes materially affect existing Members or active Class Pack holders, we will provide at least 30 days' written notice before the changes take effect.

If a material change adversely affects you, you may cancel your Membership without penalty by providing written notice before the change takes effect. Fees remain payable up to your cancellation date.

Minor changes that do not adversely affect you become effective when published.

5. Studio Rules

To ensure a safe and enjoyable experience for everyone, all clients agree to:

  • treat staff and other clients with courtesy and respect;

  • follow all instructions given by instructors;

  • use equipment safely and only as directed;

  • wear suitable exercise clothing;

  • wear grip socks where required;

  • maintain appropriate personal hygiene;

  • wipe down equipment after use where requested;

  • return equipment to its designated location;

  • respect the privacy of other clients;

  • keep mobile phones on silent during classes;

  • avoid behaviour that disrupts classes.

We reserve the right to refuse entry or remove any person whose behaviour is unsafe, disruptive, abusive or inappropriate.

6. Health & Medical Acknowledgement

You acknowledge and agree that:

  • participation in Pilates and fitness activities involves physical exertion;

  • you are responsible for determining whether you are medically fit to participate;

  • you should seek medical advice before commencing exercise if you have any concerns regarding your health;

  • you participate voluntarily and at your own risk.

You agree to immediately inform your instructor if you experience:

  • dizziness;

  • chest pain;

  • unusual shortness of breath;

  • injury;

  • illness; or

  • any condition that may affect your ability to exercise safely.

7. Pregnancy

If you are pregnant, or become pregnant during your membership, you agree to advise Athletica before participating in any class. Participation during pregnancy is entirely your responsibility.

You acknowledge that:

  • modifications may be offered where appropriate;

  • not all exercises are suitable during pregnancy;

  • Athletica recommends obtaining medical clearance before participating.

Our instructors may decline your participation in particular classes if they believe it is unsafe.

8. Existing Injuries & Medical Conditions

All new clients must complete and sign our client waiver before or at their first visit.

You agree to advise Athletica before participating if you have:

  • recent surgery;

  • chronic pain;

  • cardiovascular conditions;

  • musculoskeletal injuries;

  • neurological conditions;

  • pregnancy;

  • or any other condition that may affect safe participation.

Providing this information assists our instructors to recommend appropriate exercise modifications but does not constitute medical advice.

9. Assumption of Risk

You acknowledge that participation in Pilates and fitness activities involves inherent risks, including but not limited to:

  • muscle soreness;

  • strains and sprains;

  • falls;

  • equipment failure;

  • aggravation of existing injuries;

  • serious injury;

  • illness.

While Athletica takes reasonable care to provide a safe environment, no exercise program is completely risk free. You voluntarily accept these inherent risks to the extent permitted by law.

10. Instructor Authority

For safety reasons, instructors may:

  • modify exercises;

  • refuse particular exercises;

  • ask you to stop exercising;

  • refuse participation in a class;

  • require medical clearance before future attendance.

These decisions are made in the interests of safety and are final.

11. Minimum Age

The minimum age to attend classes is 14. Clients aged 14 to 17 require studio approval and written consent from a parent or legal guardian before attending.

Children are not permitted in the studio exercise areas unless participating in an authorised class. Children attending the studio must remain under the direct supervision of their parent or guardian at all times.

12. Personal Belongings

Clients are responsible for their own belongings. Where lockers or storage areas are provided, these are supplied for convenience only.

To the extent permitted by law, Athletica accepts no responsibility for:

  • lost property;

  • theft;

  • damage to personal belongings;

  • valuables left unattended.

Lost property may be disposed of or donated after 7 days if unclaimed.

13. Mobile Phones & Photography

To respect the experience and privacy of all clients:

  • phones should remain on silent;

  • phone conversations are not permitted inside class studios;

  • photography or filming of classes is not permitted without prior approval.

Athletica may occasionally photograph or film classes or events for promotional purposes. Reasonable efforts will be made to notify clients beforehand. If you do not wish to appear in marketing material, please advise reception before the class.

14. Studio Etiquette

Clients agree to:

  • arrive on time;

  • enter and leave quietly;

  • respect instructors;

  • respect fellow clients;

  • avoid offensive language;

  • refrain from harassment, discrimination or bullying;

  • refrain from attending under the influence of alcohol or illicit drugs.

Athletica maintains a zero-tolerance policy towards abusive or threatening behaviour.

15. Arrival for Classes

Please arrive at least 10 minutes before your scheduled class. This allows time for:

  • check-in;

  • equipment setup;

  • discussing injuries or medical conditions.

If you arrive after the class has commenced, entry may be refused where it would compromise safety or disrupt the class.

Where entry is refused due to late arrival, the booking will be treated as a No Show in accordance with these Terms.

16. Booking Classes

All classes are subject to availability. Bookings may be made through our approved booking system.

Athletica reserves the right to:

  • change instructors;

  • substitute instructors;

  • alter class formats;

  • change class durations;

  • cancel classes;

  • amend timetables.

Where reasonably possible, affected clients will be notified.

17. Waitlists

If a class is full, clients may join the waitlist. If a place becomes available, clients may automatically be moved into the class.

By joining a waitlist, you acknowledge and agree that:

  • you may be automatically added to the class at any time prior to commencement;

  • it is your responsibility to monitor your booking status;

  • once you have been moved into the class, the standard cancellation policy applies.

Athletica is not responsible if you fail to receive email or SMS notifications due to incorrect contact details or technology failures.

18. Late Cancellations

A Late Cancellation occurs where a booking is cancelled within 12 hours of the scheduled class commencement time for Group Reformer classes, and within 24 hours of the scheduled class commencement time for Equipment Studio classes.

Late Cancellation fees or forfeiture of classes apply as published on our Pricing page and in the Schedule to these Terms.

Ultimate Membership: if you hold an Ultimate Membership and cancel a class within 12 hours of the class commencing, a flat late cancellation fee of $15 will be charged to your nominated payment method.

19. No Shows

A No Show occurs where:

  • you fail to attend a booked class;

  • you fail to cancel within the required timeframe; or

  • you arrive too late to participate.

No Shows may result in:

  • forfeiture of the class;

  • applicable fees as published on our Pricing page;

  • temporary booking restrictions for repeated non-attendance.

20. Fair Use of Bookings

Bookings are intended for genuine personal attendance. Clients must not:

  • repeatedly reserve classes they do not intend to attend;

  • create multiple duplicate bookings;

  • attempt to circumvent booking limits.

Athletica reserves the right to cancel excessive future bookings or temporarily suspend booking privileges where bookings are being misused.

PART B – MEMBERSHIPS, CLASS PACKS & PAYMENTS

21. Memberships

Athletica offers a range of membership options designed to suit different lifestyles and training goals. Membership types, inclusions, pricing and benefits are published on our website and may change from time to time.

Memberships are personal to the Member and cannot be transferred, assigned, shared or sold.

22. Membership Commencement

Your Membership commences on the date specified at the time of purchase unless otherwise advised by Athletica.

By commencing a Membership, you authorise Athletica to charge all applicable Membership fees using your nominated payment method.

23. Membership Fees

Membership fees are payable in advance by recurring direct debit or another payment method approved by Athletica. Membership fees are charged on a recurring basis in accordance with your selected Membership.

Equipment Studio Memberships are billed monthly. Group Reformer Memberships are billed weekly.

Membership fees continue until your Membership is cancelled in accordance with these Terms.

24. Membership Benefits

Each Membership includes only those services specifically listed for that Membership.

Membership benefits:

  • cannot be exchanged for cash;

  • cannot be transferred to another person;

  • cannot be rolled over unless expressly stated.

Unused classes included within a Membership expire in accordance with that Membership.

25. Membership Changes

Athletica may introduce new Memberships, discontinue existing Memberships or amend Membership inclusions from time to time.

Where changes materially affect existing Members, we will provide at least 30 days' written notice before the changes take effect. If a change adversely affects you, you may cancel your Membership without penalty by providing written notice before the change takes effect.

Existing Members may be offered the opportunity to remain on their current Membership where commercially feasible, however Athletica is under no obligation to continue offering discontinued Memberships indefinitely.

26. Membership Upgrades and Downgrades

Members may request to upgrade or downgrade their Membership. Changes are subject to Athletica's approval and may only take effect from the commencement of the next billing cycle.

Any applicable price adjustments will take effect from the date the new Membership commences.

27. Direct Debit Authority

By purchasing a recurring Membership, you authorise Athletica and its nominated payment provider to automatically debit your nominated account or payment card for:

  • Membership fees;

  • overdue Membership fees;

  • failed payment fees (if applicable);

  • late cancellation fees (where applicable);

  • no-show fees (where applicable);

  • retail purchases authorised by you.

Payments are processed securely through Mindbody, our booking and payment platform. Charges will appear on your statement as Athletica Pilates.

You are responsible for ensuring sufficient funds are available on each payment date.

28. Failed Payments

If a scheduled payment cannot be processed, Athletica may:

  • attempt to process the payment again;

  • suspend your booking privileges;

  • suspend your Membership;

  • refuse entry to classes until the account is brought up to date.

Athletica may charge a reasonable administration fee for failed payments. Any fee charged will represent a genuine estimate of Athletica's administrative costs and is not intended as a penalty.

29. Outstanding Accounts

Where Membership fees remain unpaid, Athletica reserves the right to:

  • suspend your Membership;

  • cancel future bookings;

  • refuse future services;

  • recover outstanding amounts through lawful debt recovery processes.

You remain responsible for all Membership fees owing up to the effective cancellation date of your Membership.

30. Membership Holds (Freezes)

Members may request to temporarily suspend ("freeze") their Membership due to circumstances such as:

  • illness;

  • injury;

  • travel;

  • pregnancy;

  • compassionate grounds;

  • other reasons approved by Athletica.

Membership freezes are subject to the following conditions:

  • The minimum freeze period matches your payment cycle: 1 week for Group Reformer Memberships and 1 month for Equipment Studio Memberships.

  • The maximum freeze period is 12 weeks.

  • Athletica may require supporting documentation for medical freezes.

Membership payments resume automatically at the conclusion of the approved freeze period unless otherwise agreed in writing.

31. Medical Suspension

Where a Member is unable to participate due to illness or injury, Athletica may approve an extended Membership suspension upon receipt of satisfactory medical evidence. Approval is entirely at Athletica's discretion.

32. Membership Cancellation by the Member

Members may cancel their Membership by providing written notice. Notice must be submitted by email to: studio@athleticapilates.com

The required notice period is:

  • 7 days for Group Reformer Memberships;

  • 30 days for Equipment Studio Memberships.

Membership fees remain payable throughout the notice period. No refunds will be provided for unused Membership time except where required by law.

33. Cancellation by Athletica

Athletica may suspend or cancel a Membership immediately where a Member:

  • breaches these Terms;

  • behaves in an abusive or threatening manner;

  • damages Studio property;

  • repeatedly fails to comply with Studio policies;

  • repeatedly fails to make payments;

  • places the safety or wellbeing of others at risk.

Where appropriate, Athletica may provide the Member with an opportunity to remedy the breach before cancellation.

34. Membership Price Changes

Athletica reserves the right to amend Membership pricing. Members will receive at least 60 days' written notice before any price increase takes effect.

If a price increase adversely affects you, you may cancel your Membership without penalty by providing written notice before the new pricing takes effect. Fees remain payable at the existing rate up to your cancellation date.

Continued use of the Membership following the commencement of the new pricing constitutes acceptance of the revised Membership fee.

35. Fair Use Policy

Unlimited or high-frequency Memberships are intended for genuine personal use. Members must not:

  • book classes they do not intend to attend;

  • repeatedly cancel at short notice;

  • reserve multiple classes to prevent others attending;

  • share Memberships;

  • use Memberships for commercial purposes.

Where Athletica reasonably believes a Membership is being misused, we may:

  • cancel bookings;

  • restrict advance bookings;

  • suspend booking privileges;

  • suspend or terminate the Membership.

36. Booking Limits

Athletica may impose limits on:

  • the number of future bookings;

  • the number of classes booked per day;

  • advance booking periods.

Current booking limits are published on our website or booking platform.

CLASS PACKS

37. Class Packs

Class Packs are valid for the period specified at the time of purchase. Expiry dates commence from the purchase date unless otherwise stated. Unused classes expire automatically at the end of the validity period.

Class Packs are:

  • non-transferable;

  • non-refundable except where required by law;

  • not redeemable for cash.

38. Extension of Class Packs

Athletica is under no obligation to extend expired Class Packs. Extensions may be granted at Athletica's absolute discretion in exceptional circumstances, including serious illness or injury. Supporting documentation may be requested.

39. Casual Classes

Casual classes must be paid in full at the time of booking. Bookings remain subject to Athletica's cancellation policy. Failure to attend may result in forfeiture of the class fee.

GIFT VOUCHERS

40. Gift Vouchers

Gift vouchers may be redeemed only for Athletica products or services.

Gift vouchers:

  • cannot be redeemed for cash;

  • cannot be refunded;

  • cannot be replaced if lost or stolen unless required by law.

Gift vouchers are valid for at least 3 years from the date of issue, in line with the Australian Consumer Law.

RETAIL PRODUCTS

41. Retail Purchases

Athletica may sell apparel, grip socks, accessories and other retail products. Prices are displayed in Australian Dollars and include GST unless otherwise stated. Ownership of retail products transfers upon payment.

42. Returns and Exchanges

Athletica will comply with all obligations under the Australian Consumer Law. Nothing in these Terms limits your statutory consumer guarantees.

We don't accept change-of-mind returns. For hygiene reasons, this includes grip socks, drink bottles and worn apparel.

Nothing in this clause limits your rights under the Australian Consumer Law — if a product is faulty, you're entitled to a remedy.

PROMOTIONS

43. Promotions and Introductory Offers

Athletica may offer promotional pricing, introductory memberships, referral incentives or special offers from time to time.

Unless otherwise stated:

  • promotions cannot be combined;

  • promotions have no cash value;

  • promotions are subject to availability;

  • Athletica may withdraw or amend promotions at any time.

Specific promotional terms published at the time of the offer will prevail to the extent of any inconsistency.

WORKSHOPS & EVENTS

44. Workshops and Special Events

Bookings for workshops, masterclasses and special events may be subject to separate cancellation conditions. Where separate terms are published for a specific event, those terms will apply in addition to these Terms.

PART C – RETREATS, LEGAL TERMS & GENERAL PROVISIONS

45. Retreats

Athletica Pilates may organise retreats, wellness experiences, domestic or international travel, workshops and special events.

Participation in a Retreat is subject to these Terms together with any Retreat-specific information provided at the time of booking. Where there is any inconsistency, the Retreat-specific terms will prevail.

46. Retreat Bookings

A Retreat booking is confirmed only when:

  • the required deposit has been paid; and

  • Athletica Pilates has accepted the booking.

The balance of the Retreat fee must be paid by the due dates advised by Athletica Pilates.

Failure to make payments by the required dates may result in cancellation of your booking and forfeiture of your deposit, subject to applicable law and any Retreat-specific terms.

47. Retreat Cancellations

Retreat deposits are generally non-refundable unless otherwise stated in writing. All cancellation requests must be made in writing.

Refund eligibility (if any) will be determined in accordance with the cancellation schedule published for the relevant Retreat, which will be stated at the time the Retreat opens for bookings.

Where possible, Athletica Pilates may, at its discretion, allow a transfer of your booking to another participant. An administrative fee may apply.

48. Travel Requirements

Participants are solely responsible for ensuring they have:

  • valid passports;

  • visas;

  • vaccinations and medical clearances;

  • appropriate travel documentation; and

  • comprehensive travel insurance.

Athletica Pilates strongly recommends all participants obtain travel insurance covering cancellation, medical expenses, injury, and travel disruption.

49. Changes to Retreats

Athletica Pilates reserves the right to make reasonable changes to Retreats where necessary, including but not limited to changes to:

  • accommodation;

  • instructors;

  • venues;

  • activities;

  • itineraries; and

  • schedules.

Changes may be made due to weather, safety, supplier availability or circumstances beyond Athletica Pilates' reasonable control. Such changes do not automatically entitle participants to a refund.

50. Participant Conduct (Retreats)

Participants must conduct themselves respectfully at all times during Retreats.

Athletica Pilates may remove a participant from a Retreat (or refuse participation) if their behaviour is reasonably considered to be:

  • unsafe;

  • unlawful;

  • abusive or threatening;

  • discriminatory;

  • disruptive; or

  • damaging to property or the experience of others.

Where removal occurs due to misconduct, no refund will be provided to the extent permitted by law.

PRIVACY & COMMUNICATIONS

51. Privacy

Athletica Pilates collects and handles personal information in order to:

  • manage bookings and memberships;

  • deliver services;

  • communicate operational updates;

  • process payments; and

  • comply with legal obligations.

Personal information is handled in accordance with our Privacy Policy, available on our website. We do not sell personal information.

We may disclose personal information to third-party service providers where reasonably necessary, including:

  • payment processors;

  • booking system providers;

  • IT and software providers;

  • professional advisers;

  • insurers; and

  • government authorities where required by law.

52. Electronic Communications

By using our services, you consent to receive electronic communications from Athletica Pilates relating to:

  • bookings and class reminders;

  • membership administration;

  • payments and invoices;

  • timetable changes;

  • Studio updates and closures; and

  • operational notices.

You may opt out of marketing communications at any time. However, you will continue to receive essential service-related communications where required for the operation of your Membership or bookings.

INTELLECTUAL PROPERTY

53. Intellectual Property

All intellectual property associated with Athletica Pilates remains the property of Athletica Pilates or its licensors.

This includes (without limitation):

  • branding, logos and trade marks;

  • class formats and programming structures;

  • written materials;

  • videos and photographs;

  • website content;

  • training materials; and

  • digital content.

You must not copy, reproduce, distribute, modify or commercially exploit any Athletica Pilates intellectual property without prior written consent.

LIABILITY & RISK

54. Assumption of Risk

You acknowledge that participation in Pilates, fitness classes, workshops and Retreats involves inherent physical risks, including but not limited to:

  • muscular strain or soreness;

  • sprains or injuries;

  • aggravation of pre-existing conditions;

  • falls or accidents; and

  • equipment-related incidents.

You voluntarily assume all such risks to the fullest extent permitted by law.

55. Release and Limitation of Liability

To the maximum extent permitted by law, Athletica Pilates excludes all liability for any loss, damage, injury or expense arising from your participation in any class, service, Retreat, workshop or use of our facilities, except where such liability cannot be excluded under Australian law.

Where liability cannot be excluded, it is limited, at Athletica Pilates' option, to:

  • resupplying the relevant services; or

  • paying the cost of having the services resupplied.

Nothing in these Terms excludes, restricts or modifies any consumer rights under the Australian Consumer Law.

56. Recreational Services

You acknowledge that Pilates and related fitness activities are recreational activities involving a degree of physical exertion and risk.

To the extent permitted by law, you agree that Athletica Pilates is not liable for harm suffered as a result of participation in these recreational activities.

This clause should be read subject to applicable legislation, including the Civil Liability Act 2002 (NSW) and the Australian Consumer Law.

OPERATIONAL TERMS

57. Temporary Closure

Athletica Pilates may temporarily suspend or modify services due to circumstances including, but not limited to:

  • maintenance or renovations;

  • staff illness or unavailability;

  • public health requirements;

  • natural disasters or extreme weather;

  • utility or system failures; or

  • other events beyond reasonable control.

Where practicable, Members will be notified in advance. Alternative arrangements may be offered at Athletica Pilates' discretion.

58. Force Majeure

Athletica Pilates is not liable for any delay or failure to perform its obligations where such failure is caused by events beyond its reasonable control, including but not limited to:

  • natural disasters;

  • pandemics or epidemics;

  • government restrictions;

  • industrial disputes;

  • power or internet outages; or

  • supplier failures.

If a Force Majeure event continues for an extended period, Athletica Pilates may suspend or cancel affected services.

59. Damage to Property

Clients are responsible for any damage caused to Studio property or equipment as a result of intentional misuse or negligence. Athletica Pilates may recover reasonable costs associated with repair or replacement.

60. Lost Property

Athletica Pilates will make reasonable efforts to retain lost property. Unclaimed items may be donated, disposed of or recycled after 7 days.

Athletica Pilates accepts no responsibility for lost or damaged personal belongings.

TERMINATION & SUSPENSION

61. Suspension of Services

Athletica Pilates may suspend or restrict access to services where reasonably necessary to:

  • protect the safety of clients or staff;

  • investigate suspected breaches of these Terms;

  • address unpaid accounts; or

  • comply with legal obligations.

62. Termination

Athletica Pilates may terminate or suspend a Membership or refuse future services where a Client:

  • breaches these Terms;

  • engages in abusive, threatening or inappropriate behaviour;

  • repeatedly fails to pay fees;

  • compromises the safety or wellbeing of others; or

  • otherwise engages in conduct deemed inappropriate at Athletica Pilates' reasonable discretion.

Termination does not affect rights or obligations accrued prior to termination.

FEEDBACK & COMPLAINTS

63. Complaints

We want every experience at Athletica to be a positive one. If something isn't right, please raise it with our team in the studio first — most issues can be resolved on the spot.

If you would prefer to put your complaint in writing, or the issue isn't resolved, please email studio@athleticapilates.com. We will acknowledge your complaint promptly and aim to resolve it within a reasonable timeframe.

If you are not satisfied with the outcome, you may contact NSW Fair Trading (fairtrading.nsw.gov.au) for further assistance.

GENERAL TERMS

64. Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions will continue in full force and effect.

65. Waiver

Failure by Athletica Pilates to enforce any provision of these Terms does not constitute a waiver of that provision or any other rights.

66. Entire Agreement

These Terms, together with any Membership terms, Retreat information, Privacy Policy and any other policies published by Athletica Pilates, constitute the entire agreement between you and Athletica Pilates.

67. Sale or Transfer of Business

Athletica Pilates may sell, transfer, assign, restructure or otherwise dispose of all or part of its business, assets or operations at any time, including as part of a sale of business, merger, acquisition or corporate restructure.

In the event of such a transaction, you acknowledge and agree that:

  • your Membership, Class Pack, Booking account and/or any agreement with Athletica Pilates may be assigned or transferred to a third party acquiring the business;

  • the incoming owner or operator will assume Athletica Pilates' rights and obligations under these Terms to the extent of the transfer; and

  • your personal information and account data (including booking and attendance history) may be disclosed to and transferred to that third party as part of the transaction.

Any transfer of personal information will be conducted in accordance with the Privacy Act 1988 (Cth) and our Privacy Policy.

To the extent permitted by law, such transfer does not constitute a breach of these Terms and does not entitle you to a refund or termination solely due to a change of ownership.

Where reasonably practicable, we will take reasonable steps to notify Members of any material change in ownership or control of the business.

68. Governing Law

These Terms are governed by the laws of New South Wales, Australia. You submit to the exclusive jurisdiction of the courts of New South Wales.

SCHEDULE – MEMBERSHIP & CLASS-SPECIFIC TERMS

The terms in this Schedule apply to the specific membership or class type you hold, in addition to the Terms & Conditions above. Current pricing for all options is published on our Pricing page.

PRIVATE CLASSES

  • Confirmation of a Private Class booking is secured upon payment.

  • Cancellations must be provided in writing with at least 18 hours' notice. Credit notes will not be provided where notice falls outside this period.

  • Cancellations should be made by phone and confirmed in writing by email to studio@athleticapilates.com. Cancellations via social media will not be accepted.

  • No refunds, transfers, suspensions or extensions are offered on private classes except where required by law.

GROUP REFORMER MEMBERSHIPS

Group Reformer Membership options include:

  • 2 Classes Per Week Membership — maximum 2 classes per week.

  • A/P Ultimate Membership — up to 7 classes per week.

The following terms apply to all Group Reformer Memberships:

  • Memberships are billed on a 7-day cycle by direct debit using the payment method stored on your Mindbody account.

  • Memberships have a minimum commitment of 12 weeks. After this period, you may cancel with a minimum of 7 days' written notice, in line with these Terms & Conditions.

  • Memberships renew automatically unless cancelled in accordance with these Terms & Conditions. Membership fees are non-refundable except where required by law.

  • Class credits included in your Membership are valid only for the week of issue. Unused credits expire at the end of the week and cannot be carried over, transferred, or redeemed for cash.

  • Late cancellations (within 12 hours of class commencement) result in forfeiture of the class credit. Ultimate Membership clients are instead charged a flat late cancellation fee of $15 per late-cancelled class.

  • Should you wish to book more classes than your Membership allocation, Mindbody will offer the option to purchase additional class credits. All classes must be prepaid. If a booking remains unpaid, the card on file will automatically be charged 3 hours before the scheduled class.

  • You are responsible for ensuring sufficient funds are available for each scheduled payment. Additional charges from third-party providers due to insufficient funds are your responsibility.

  • If a scheduled payment fails, Mindbody will attempt to process the payment for up to 3 consecutive days. During this time, your account may be restricted from making new bookings. Failed Membership payments incur a $15 late fee for each day the payment remains outstanding. If a payment remains unpaid after 3 days, all active bookings will be cancelled and your Membership will be placed on hold until the account is settled.

EQUIPMENT STUDIO MEMBERSHIPS

Equipment Studio Membership options include:

  • 2 Classes Per Week Membership — maximum 2 classes per week.

  • 3 Classes Per Week Membership — maximum 3 classes per week.

  • 4 Classes Per Week Membership — maximum 4 classes per week.

The following terms apply to all Equipment Studio Memberships:

  • Memberships are billed on a 30-day cycle by direct debit using the payment method stored on your Mindbody account.

  • Memberships have a minimum commitment of 12 weeks. After this period, you may cancel with a minimum of 30 days' written notice, in line with these Terms & Conditions.

  • Memberships renew automatically unless cancelled in accordance with these Terms & Conditions. Membership fees are non-refundable except where required by law.

  • Class credits included in your Membership are valid only for the week of issue. Unused credits expire at the end of the week and cannot be carried over, transferred, or redeemed for cash.

  • Late cancellations (within 24 hours of class commencement) result in forfeiture of the class credit.

  • Should you wish to book more classes than your Membership allocation, Mindbody will offer the option to purchase additional class credits. All classes must be prepaid. If a booking remains unpaid, the card on file will automatically be charged 3 hours before the scheduled class.

RETREAT CANCELLATION SCHEDULE

Unless otherwise stated in the Retreat-specific terms provided at the time of booking, the following cancellation schedule applies to Retreat bookings:

  • Between 90 and 45 days (inclusive) prior to the arrival date: a cancellation fee equal to 50% of the total cost of the booking applies.

  • Less than 45 days prior to the arrival date: a cancellation fee equal to 100% of the total cost of the booking (including accommodation and food) applies.

If government restrictions prevent the Retreat from proceeding, the amount paid will be held as a credit towards a future Retreat, to be taken within 12 months of the original date. Athletica Pilates reserves the right to adjust pricing where the new date falls within a different pricing period for the venue.
